TERMS & CONDITIONS
(Updated for 2025)
1. Scope of Work
All concrete work will be performed according to the written estimate provided to the customer. The estimate outlines the specific materials, dimensions, processes, and deliverables included. Any item not listed in the estimate is not included in the contracted scope.
2. Deposit & Payment Terms
A 50% deposit is required to schedule the project and secure labor and materials.
The remaining 50% balance is due immediately upon project completion and prior to removal of equipment from the job site.
Payments may be made by credit card, ACH, or other approved methods.
Failure to pay the final balance within the terms may result in:
Late fees
Interest charges
Work stoppage
Lien filings
Collections
Deposit is non-refundable once materials are ordered or work scheduling is finalized.
3. Change Orders
Any changes requested by the customer after the estimate is approved—such as size adjustments, materials, added features, or additional labor—must be documented via a written Change Order.
Change Orders may result in additional charges and revised scheduling.
4. Site Access & Preparation
The customer is responsible for ensuring proper access to the job site on the scheduled date, including:
Removal of vehicles, furniture, debris, or obstacles
Unlocking gates
Clearing work areas
Ensuring utilities are marked (Iowa One Call 811)
Delays caused by incomplete site preparation may result in rescheduling and project completion delay.
5. Weather & Scheduling
Concrete work is weather-dependent. Start dates may shift due to:
Rain
Snow
Extreme temperatures
High humidity
Ground saturation
Colin Concrete Des Moines will notify customers of any schedule adjustments. Weather delays do not void the contract.
6. Unforeseen Conditions
The estimate is based on visible site conditions. Additional charges may apply if hidden or unforeseen conditions arise, including but not limited to:
Soft or unstable subgrade
Drainage issues
Tree roots
Rock or debris
Underground utilities
Incorrect elevations
These will be communicated to the customer before continuing.
7. Workmanship & Warranty
Colin Concrete Des Moines provides a workmanship warranty covering installation defects under normal use.
The warranty does not cover:
Hairline cracking (normal in concrete)
Damage caused by de-icing salts
Soil movement or settling
Weather-related expansion/contraction
Heavy equipment damage
Customer misuse or neglect
Warranty is voided if third parties alter the concrete after installation.
8. Property Damage & Liability
Reasonable care will be taken to avoid damage to lawns, driveways, landscaping, sprinklers, or surrounding property.
However, the customer acknowledges that equipment access may require crossing lawns or landscaped areas.
Colin Concrete Des Moines is not responsible for:
Pre-existing damage
Underground lines not marked
Damage caused by required equipment access
9. Automated Messages, Notifications & Communication Consent
By submitting a form, scheduling an estimate, approving a proposal, or providing your contact information, you consent to receive:
Appointment confirmations
Estimate reminders
Proposal reminders
Payment reminders
Job status notifications
Review requests
Project updates
Customer service follow-ups
Communication may occur through:

✔ Automated voice alerts
✔ Automated pipeline notifications
✔ Appointment reminders
You may opt out at any time by replying STOP to SMS messages or using the unsubscribe link in emails.
Consent to automated messages is not a condition of purchase and complies with TCPA, FCC, and GoHighLevel standards.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
You can cancel the SMS service at any time. Simply text “STOP” to the shortcode. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

Carriers are not liable for delayed or undelivered messages.

10. Cancellation Policy
If the customer cancels the project after paying the deposit, the deposit may be withheld to cover labor, scheduling, and material costs already allocated or expended.
11. Completion & Final Payment
A job is considered complete when:
The agreed-upon scope is fulfilled
Final finishing is complete
Equipment is ready for removal
Concrete is curing
Final payment is due immediately upon completion.
12. Acceptance of Terms
Approval of the estimate, payment of the deposit, or digital signature constitutes acceptance of these Terms & Conditions.
